Cultural practices vs statutory laws: A case study on Hindu inheritance disputes

Abstract: This research paper examines the interplay between cultural practices and statutory laws in Hindu inheritance disputes, focusing on the challenges faced in reconciling traditional norms with modern legal frameworks. Despite the progressive amendments to the Hindu Succession Act, 1956, particularly the 2005 amendment granting daughters equal inheritance rights, societal resistance rooted in patriarchal norms continues to impede their effective implementation. The paper also discusses the role of the judiciary, local governance, and community-based dispute resolution mechanisms in either facilitating or hindering access to justice.Based on these insights, the research proposes a multi-pronged approach to legal and social reform, emphasizing the need for legal literacy campaigns, simplification of judicial processes, economic empowerment of women, and cultural sensitization to challenge patriarchal norms. By addressing the systemic and cultural barriers to equitable inheritance, this paper advocates for a holistic framework that bridges the gap between statutory provisions and societal realities. The findings underscore the importance of integrating legal, social, and cultural strategies to ensure that inheritance laws serve as effective tools for gender justice, promoting broader socio-economic equity and progress.
