Development of the law of tort in the Indian subcontinent: A study with special reference to Bangladesh

Abstract: This paper emphasizes the gradual development of tort law in the Indian subcontinent, particularly Bangladesh without a Tort Act. This law is being used in the Indian subcontinent through various enacted laws. It argues that the codification of tort law shall be more helpful for the Bangladeshi legal arena. This manuscript discusses the historical background of tort law, the basic types of torts and their subject matter. Particularly, it explores the statutory laws relating to torts in Bangladesh and analyses the case laws on tort-related issues in the Indian subcontinent, namely Bangladeshi cases. Finally, this paper explores the necessity of codified tort law in Bangladesh.
