Data privacy and consumer protection in India: Examining the effectiveness of regulatory frameworks

Abstract: In the digital age, data privacy and consumer protection have emerged as critical issues, particularly in a rapidly growing economy like India. As the country witnesses exponential growth in digital transactions, e-commerce, and data-driven services, the effectiveness of its regulatory frameworks in safeguarding consumer rights and data privacy has come under increasing scrutiny. This paper critically examines the regulatory frameworks governing data privacy and consumer protection in India, focusing on the efficacy of the Personal Data Protection Bill, 2019, and the Consumer Protection Act, 2019. Utilizing a comprehensive secondary data analysis of government reports, legal documents, policy briefs, and relevant case studies, the research evaluates the strengths and limitations of these regulatory instruments in addressing the challenges posed by the digital economy. The study highlights key areas where regulatory gaps persist, such as the enforcement of data protection measures, corporate compliance, and the role of the judiciary in adjudicating data breaches and consumer disputes. Furthermore, the paper explores the implications of emerging global data privacy norms, such as the General Data Protection Regulation (GDPR), and their potential influence on India's regulatory landscape. The findings suggest that while India's regulatory frameworks are evolving to address data privacy and consumer protection, significant challenges remain in terms of implementation, awareness, and alignment with global standards. This paper concludes with policy recommendations aimed at enhancing the robustness of India's regulatory framework, ensuring consumer rights are adequately protected in the digital age.
