Right to information and its role in promoting good governance

Abstract: As the cornerstone of accountability and openness in government, the Right to Information (RTI) is essential to the operation of any democracy. Enshrined in Article 19(1)(a) of the Indian Constitution, RTI gives citizens the ability to access information held by public agencies and is essential to the larger freedom of speech and expression. An important turning point was the passage of the Right to Information Act in 2005, which gave regular people a powerful weapon to fight corruption and examine how the government is run. The successful application of the RTI Act in India is still a controversial topic, even after more than 18 years after it was first introduced. Its full realisation is hampered by a number of issues, such as ineffective governance, cases of information misuse, and insufficient legal protections for whistle-blowers. Concerns have been made about recent changes to the RTI Act that may reduce its effectiveness and reach. This essay explores the judicial and constitutional foundations of RTI in India, highlighting both the changing court interpretations that influence its implementation and the constitutional mandate of the law. By promoting educated citizens and guaranteeing governmental accountability, it emphasises the vital role that RTI plays in fostering a participatory democracy. The study also looks at the Act's enduring flaws and weaknesses that prevent it from being implemented effectively. This paper evaluates the effect of RTI on citizen empowerment and governance transparency by looking at case studies and comparative analysis. It points out areas that require institutional and legal adjustments in order to boost RTI procedures and lessen current difficulties. In order to ensure that RTI laws continue to be strong defences for democratic government in India and elsewhere, this paper concludes by urging fresh efforts to protect and strengthen them.
