Strengthening merger control framework in India: Evolving trends, challenges, and regulatory reforms

Abstract: This paper explores the evolving role of the Competition Commission of India (CCI) in merger review, assessing its effectiveness in meeting legislative expectations and anticipating future developments. The study examines CCI’s approach from both substantive and procedural perspectives, focusing on its handling of complex merger cases, initiatives for efficient case disposal, and unique features of India’s merger control framework.The analysis highlights that CCI, through continuous reforms, has emerged as one of the most dynamic regulators among major global merger control jurisdictions. It has demonstrated a business-friendly outlook while effectively addressing the complexities of high-stakes transactions. Moreover, CCI’s adaptability positions it well to tackle challenges arising from the evolving digital and new-age economy.
