Behaviors of employers delaying or evading payment of social insurance, health insurance, unemployment insurance, and some issues for discussion

Abstract: This article discusses several issues related to employers' delayed or evaded payment of social insurance, health insurance, and unemployment insurance for employees. Based on this analysis, the article proposes recommendations for improving relevant legal regulations. This article discusses several issues related to employers' delayed or evaded payment of social insurance, health insurance, and unemployment insurance for employees. Based on this analysis, the article proposes recommendations for improving relevant legal regulations. By analyzing existing publications and data, the article has established that there are cases where employers have not been remitting insurance premiums to the Vietnam Social Security (VSS). Some reasons include a hostile business environment due to COVID-19-related challenges, conflicts in some parts of the world, and unscrupulous businesses out to benefit illegally. The article has also established that although there are current laws, such as the Law on Social Insurance 2024 and the Law Amending and Supplementing Several Articles of the Law on Health Insurance 2024, there is a need to improve the enforcement of the laws. Also, the guiding regulations and legal documents should be amended and supplemented to ensure the effective operationalization of the statutes.
