Abstract: This paper examines the judicial responses to custodial rape in India, a grave violation of human rights that disproportionately affects marginalized communities. It explores the criminal justice system's approach to custodial rape and analyzes it through a victimological perspective. Through qualitative data, including case studies from Jaipur, Rajasthan, this research highlights the systemic issues, barriers to justice, and the psychological, social, and legal implications for victims. The study incorporates judicial rulings, laws, and institutional practices to assess their efficacy in protecting victims and ensuring accountability. The findings aim to contribute to reforms in the Indian criminal justice system, focusing on improving victim support, judicial accountability, and preventive measures.
