Cybercrime and social media platforms: Legal accountability in the Indian context

Abstract: The rapid growth of social media platforms has reshaped communication, commerce, and governance, while simultaneously heightening cybercrime risks, thereby presenting substantial challenges to India's legal framework. This study examines the multifaceted nature of cybercrime on social media, such as online harassment, identity theft, misinformation, hate speech, financial fraud, and child exploitation. It delves into the regulatory landscape under the Information Technology Act, 2000, and explores judicial interpretations addressing intermediary liability, free speech, privacy, and public order. The study highlights the role of technology in both enabling and mitigating cybercrimes and proposes a collaborative approach among stakeholders to strengthen accountability while safeguarding constitutional rights. Through this comprehensive analysis, the paper aims to contribute to the ongoing discourse on balancing innovation with regulation in the digital realm.
