Abstract: In India, affirmative action has been a critical technique for resolving historical injustices against vulnerable section, particularly the Scheduled Castes and Tribes. The subclassification of these categories is intended to guarantee that the benefits of affirmative action reach the most disadvantaged individuals. However, this strategy has proved contentious, often resulting in judicial challenges. The case of State of Punjab v. Davinder Singh1 is a watershed moment in this debate, raising serious concerns regarding the criterion for subclassification, its justification, and its compatibility with constitutional obligations.The research study seeks to contribute to the continuing discussion about how to make affirmative action more responsive to the diverse needs of Scheduled Castes and Scheduled Tribes by examining the Davinder Singh decision through a judicial lens. The case demonstrates the challenges of addressing intra-group inequities, as well as the judiciary's role in interpreting social justice policies. Through the lens of this case, the study investigates the contradictions between the necessity for targeted welfare measures and the values of equality entrenched in the Indian Constitution. The paper intends to investigate the ramifications of this verdict on the larger affirmative action framework in India, assess the judicial rationale, and provide recommendations for future policy considerations.
